SARS Specialist Legislative Policy Job Description
Job Purpose:
The main purpose is to provide expert advice and proficient support in the research, drafting and development of tax administration policy and legislation. This includes ensuring that SARS’s tax policy is in line with international law. The role involves the drafting of primary and subordinate legislation and opinion/memorandums which will support tax policy development and impact the SARS operating environment, as well as dealing with tax administration interpretative enquiries and litigation.
Minimum Qualification & Experience Required:
- NQF Level: NQF Level 07
Qualification Type: Bachelor`s Degrees or Advanced Diplomas
Academic Field: Legal, Tax, or Business and Commerce and Studies
Academic Sub-Field: Tax, Legal Drafting and Accounting
Experience:
- 8 years post graduate experience, of which at least five years’ experience is in the field of tax law and interpretation, tax administration law and interpretation or legal drafting and application of the provisions of the Income Tax Act, Value-Added Tax Act and preferably most of the other tax Acts, including the Tax Administration Act, as well
- Professional accountant or legal practitioner or relevant technical qualifications.
Key Job Outputs:
- Develop an understanding of the interaction between tax legal instruments and the economy of the country.
- Conduct research to investigate areas of legislative shortcomings and to provide prompt, workable and tactical solutions to address the shortcomings identified.
- Drafting of policy documents and guides explaining aspects of the tax administration laws including map out procedures, provide an operational framework or provide guidelines on the interpretation of legislation.
- Drafting of legal opinions to enable decisions making regarding SARS operational, tax administration and taxation related issues.
- Consider and determine whether proposals for legislative amendments should be incorporated in the tax administration laws amendment and taxation laws amendment Acts.
- Draft and prepare legislation to amend tax administration laws, including secondary law such as regulations, to implement tax policy.
- Assistance with briefing of Parliamentary Committees on legislation before it is passed in the National Assembly and the National Council of Provinces.
- Constantly see value-added process improvements, initiatives and services to deliver on the business operational strategy and objectives.
- Plan, organise and prioritise predefined and set deliverables within own area of work and specialisation.
- Provide internal assistance (e.g. training) on interpretation and implementation of new legislation.
Governance:
Ensure that completed work adheres to relevant policies, procedures, governance and legislative requirements and report on deviations & discrepancies.
Implement and provide input into the development of tactical compliance risk responses in line with SARS strategic objectives.
